BTW, this is a change from how it used to be.
I do not know when it was changed but, it used to be you could not apply or have the poison process if it was higher level then your level.
That is not the case anymore as others have explained and I did a quick test to verify it.

there was a bug for a while that if the weapon had a proc that was higher then your lvl then the poison would not fire you would get the message you are not high enough
